Experience
- Professional activity, primarily focused on private law matters.
-
Practice of law in the judicial departments of San Isidro, San Martin and Lomas de Zamora, from 2002 to late 2016.
Reasons for suspending the practice of law
- The existence of “judicial errors”; “abnormal functioning”; “lack of service” of justice; bad faith or fraud, not recognized, but objectively verifiable. It should be noted that, in the cases in which the indicated judicial acts occurred (issue of rulings and sentences), objectively contradictory with the facts of the case, law and equity, express provisions of the Civil Code were ignored (on the instruments public and full faith with respect to the facts that the Public Official announces as fulfilled by himself or that have happened in his presence); others from the Code of Civil and Commercial Procedure of the Province of Buenos Aires (in particular, regarding the appropriate means and the term, for the challenge of a public instrument); and regulations contained in the Agreements of the S.C.B.A. (among others, regarding the “Instructions for the personnel of the offices of Orders and Notifications of obligations, ushers and Justice officials").
- There was also evidence of the rupture of the “logical principle of identity”, among other considerations: a) In the face of the erroneous application of a legal doctrine (because a report drawn up by the Registrar of a Tribunal is not a judgment; and the applied doctrine referred to the erroneous challenge of a judicial act, through the mechanism of refutation of falsehood); and b) For mistakenly taking the request for copies to form a nullity incident, for the same nullity incident.
- In addition, the violation of the “logical principle of non-contradiction” was manifested in the preparation of a report by the secretary of a magistrate on the act of notification and transmission of an incident of nullity, which was contrary to the information given by the notifying officer who took part in that act. This would also have been an unequivocal logical absurdity.
- It should be noted that he would only resume his professional activity if he became aware of the performance of actions aimed at reversing the lived experience (uncertainty in the application of the law, when there must be certainty), aimed at combating ignorance of the rules, by the of Magistrates and Judicial Officials, such as corruption in the Administration of Justice (Judiciary and Bar Associations).
A legal aphorism
Here is a first sketch of that style of writing, the result of my professional experience:
-
«
S.A. or S.C.A., the 'lack of action' exception, that's the problem.

Procedural knowledge related to Design
The activity developed by the author, linked to Design,
from 2008 to the present, has consisted of:
- Planning, design, implementation and maintenance of the Proyecto WWW;
- Planning of visual communication, intended to transmit specific messages, for specific purposes;
- The union of design with a hierarchy of contents;
- The construction of hypertext documents, adaptive web design or responsive, for display on different output devices (computer screen, mobile phone, etc).
- The use of digital image editing programs, such as GIMP (GNU Image Manipulation Program) and ImageMagick, for retouching and editing images, drawing free shapes, resizing, cropping, making photomontages, converting to different formats; and other more specialized tasks, such as its use in certain techniques of “Digital Image Processing”.
Main lines of thought
Through them, it is intended to provide concise and reasonable stimuli, which give rise to a functional reaction in our society.
Philosophy

Perceptions, unlike facts, depend on the subjects of knowledge; in particular, on their own conceptual frameworks.

Let's check some of our perceptions, to find the realities behind the appearances. Let's observe the actions of people, to see if they correspond, or not, with their promises.

Moderate skepticism allows us to make a realistic exploration of the world. Doubt, but only when there are reasons to do so; that is, when the facts do not correspond to a verifiable knowledge.

The respect, integrity and independence of the institutions of a federal and republican system of government are not incompatible with the full exercise of the right to free expression (articles 14, 28, 32 and 33 of the Argentine National Constitution). Especially when the institutions, by their own actions or omissions, may be subject to well-founded criticism.

In Argentina, we must ask our representatives to create and implement suitability and management control mechanisms, as essential requirements for the appointment and permanence in office of any public official.

In Argentina, we must put aside "fictions"; everyone must do their job and assume their responsibility.

It is serious for any citizen to use academic titles that do not belong to him (performing the acts of a profession is a crime - article 247 of the Argentine Penal Code); but it is more serious, that the conduct described be performed by someone who occupies or aspires to public office. Great care must be taken not to attribute academic titles (such as the Doctor) to those who do not hold them. This is also a matter of university "ethics" and respect for those who legitimately obtained them.

There is an obligation on the part of the State to provide quality public education, so that no one who strives is left without opportunities; the need for citizen action, to monitor the efficiency and transparency of each government’s actions; and the need for ethical qualities, as an indispensable condition for participating in the political life of the Nation.

Saving the institutions that make up a financial system, through the application of "restrictive measures" that affect the citizen, involves socializing the losses, privatize profits and ignore the degree of political and legal responsibility of government management.

Freedom of thought and expression (fundamental human right) determines the quality of democracy. It is damaged when “relativism” and “constructivism” (branches of “subjective idealism” —philosophical current—) are legislatively imposed. In particular, the freedom of thought of those who have opted for a worldview akin to “scientific realism” is restricted.

The State must ensure transparency in the use of technology. Citizens should be able to monitor the processing of data, ensuring the security of the computer systems used. And, without pretending to ignore the existence of code analysis tools, the source code should be publicly available, for inspection by citizens (this would also enable an open discussion on possible improvements in the programmes used). In this respect, the acceptance of dogmas (beliefs considered impregnable, in the face of arguments and experience) should not be required, as is the case in other areas.

Equality before the law
-
«
It is necessary to generate the culture of "transparency"; as long as there is a culture of "vividness", the principle of equality before the law will continue to lose sociological validity.

Administration of Justice
-
«
Do independent candidates have the same possibility of access to the judiciary as the relatives of judges, officials and members of the institutes and commissions of the Bar Association?. In a Court, does affiliation to a certain political party prevail among its officers and employees?. Knowing this is relevant, in order to be able to foresee situations that may affect the democratic principle of equality before the law and the necessary impartiality in all judicial processes. Likewise, that knowledge can be useful when it comes to resolving a situation linked to an inadequate or anomalous functioning of the Administration of Justice.

Court holders may derive tasks, but should not delegate them. The judicial function should be assumed and performed only by professional staff. It is necessary to reflect on the attribution of certain tasks (employees who dispatch or take hearings, secretaries who plan sentences, etc.).

«
In order to improve the Justice Service, real performance indicators must be implemented and mechanisms must be established to enable the management of each court to be actively monitored. This could be achieved through the periodic review of the judicial files in process, carried out by a team composed of academic researchers, representatives of the Professional Associations and the Magistrates' Associations (outside the inspected jurisdiction, given the moral need to perform the task with intellectual honesty and beyond reasonable suspicion).

«
The incorrect analysis (detailed study) of the judicial documents and the documentary accompanying them results in a waste of judicial activity, to the detriment of the persons concerned, the professionals and the Administration of Justice itself.

Achieving “objective legal truth” is the job of the lawyer and the judge.
»
JVS
-
«
There are two very important values in any judicial process: a) The least number of “errors” that the magistrates may incur; and b) “legal certainty”, which consists, in general, of the citizen's expectation of being able to infer what the action of the power will be, in the application of the law.

The serious and manifest error, from which contradictory conclusions emerge with the objective evidence of the case, implies, in addition to arbitrariness, a problem of political and legal responsibility (civil and/or criminal).

The selection of data that confirm a hypothesis, ignoring those that contradict it, can not only be seen in the results of some scientific research. We can also find it in some court decisions.
